DEFINITIONS
Client refers to you, the person or business acquiring the services of Crystal Wizard Studios which is typically, but not limited to, a real estate agent or homeowner.
Material refers to all photographs, videos, floor plans, Matterport Tours, and any other printed or digital media created by Crystal Wizard Studios for the Client representing the Property.
Property is the property for which you are acquiring our services to film, photograph, and create Material for which includes but is not limited to the outside of the property, interior and exterior of any and all structures including the house.
Session refers to the event where the photographer or videographer representing Crystal Wizard Studios shows up at the Property to photograph and/or video record the Property.
COPYRIGHT
Crystal Wizard Studios owns full copyrights to all parts of the Material, all photos and raw video clips taken at the Property.
All Material produced for the Client may be used by the Client for all marketing associated with the current sale of the Property in accordance with local MLS rules.
Only the Client is authorized to use the Material. If someone else like another agent, homeowner, or stager wishes to have a copy of the Material, please have them get in touch with us so we can issue them a license.
The Material produced for the Client may not be edited in any way. If you wish to have any edits made please let us know we’ll be glad to help out.
PAYMENT
Payment must be received first before the Material will be released to you. An invoice will be sent to you the day of your shoot. Payment is due upon receipt of the invoice. Payments can be made via e-transfer, cash, or credit card, through e-transfer is preferred.
PROPERTY
CONDITIONS
The Client is responsible for ensuring that the Property is clean and fully prepared to be photographed/filmed for the scheduled time. If you need more time to prepare the property we ask that you provide us at least 24 hours notice.
If the photographer shows up and the property is not ready to be shot, or the photographer will be delayed due to reasons beyond the photographer’s control (such as no key in lock box, agent/homeowner not home, construction, etc…) then the photographer will leave and a cancelation fee of $75 will apply. The photographer will not wait around for the property to become ready.
Any pets must be contained or removed from the Property for the Session.
WEATHER
POLICY
We can shoot outside in most weather conditions except for rain. Drones also cannot be flown in certain conditions such as if there is too much wind, rain, or is the cloud cover is too low. It is the responsibility of the Client to check the weather forecast ahead of time and be aware if the Session will need to be re-scheduled.
QUALITY of
service
As professional photographers/videographers we know how to shoot your house to make it look its best. By accepting services from Crystal Wizard Studios you agree to accept the photographic, video, and editing choices and decisions made by us. Any changes to your Material requested after it has already been delivered will be billed at $50/hr. Changes requested after 2 weeks will incur an additional archive retrieval fee of $50
If you have any special requests, items, locations, or rooms to include or exclude, things to be aware of, or anything of importance we must be made aware before we start shooting the property.
If you are not pleased with the photos or videos due to reasons related to the weather conditions at the time of the shoot or anything to do with the property not being prepared (cleanliness, items or junk in the way, clutter, etc…) and you chose not to re-schedule, we can schedule a re-shoot but it will be at full price.
MATERIAL
DELIVERY
Our goal is to deliver your Material within 24 hours of returning back to the studio from the Session. However there may be occasions when we require more time to process your job based on how much editing is required, how many photographs were taken, how many services you have ordered from us, etc… In such cases we will advise you prior to the Session if we think we might need more time.
Once you have received your Material we advise that you keep it in a secure place and make a backup. We will keep copies hosted on our cloud service for 2 weeks after which time they will be taken down. Any copies requested after this will incur a $50 service charge.
Matterport tours are hosted for 90 days after which time they will be removed. Additional hosting time can be purchased separately.
FORCE
MAJEURE
Crystal Wizard Studios, any of its agents, employees or contractors are not responsible for any costs or damages due to delays or failures to provide service under this agreement, arising out of any cause outside of our control including but not limited to Acts of God, fire, flood, explosion, earthquake, or other natural forces, war, civil unrest, accident, work stoppage, power or other mechanical failure, governmental action, acts of terrorism or technical/communication disruption.
LIMITS OF
LIABILITY
The Material is only a representation of the Property and we do not guarantee the accuracy of the Property or its contents with regards to scale, dimension, colour accuracy, or contents included inside or outside of the house. As professional photographers and videographers we do our best to represent your property with as much accuracy as possible.
Under any and all circumstances, the liability of Crystal Wizard Studios is limited only to the amount paid for the Material by the Client for the Property.
CANCELLING &
RESCHEDULING
You agree to provide at least 24 hours notice via phone call or cell phone text message if you need to cancel or reschedule the Session. If no such notice is received or you cancel within 24 hours you will be billed for a cancellation fee of $100
If we need to return to the property for reasons which are not our fault, there will be a $75 service fee plus any additional travel fees if your property is outside of our normal operating zone. This includes, but is not limited to: property not being ready, staging incomplete, construction, agent/owner not home, no key in lockbox, etc... This does include partial photo shoots where the exterior may not be ready or certain rooms are incomplete and the photographer is required to return.
AGREEMENT
By hiring Crystal Wizard Studios to provide photographic or video services, you are agreeing to be bound by these terms and conditions. You are also acknowledging that such agreement constitutes a binding contract between you and Crystal Wizard Studios.
